1. Introduction
James Drake Media (“we”, “us”, “our”) is a brand of Art and Science UK Limited, a company incorporated in England and Wales under company number 15807336, whose registered office is at Unit 6, 30 Friern Park, London, United Kingdom, N12 9DA. Art and Science UK Limited is the data controller responsible for the personal data described in this policy.
James Drake Media is an AI-native film and production studio. We create original film, video and branded content, and we produce and deliver live and industry events. This privacy policy applies to personal data we collect through our website, and in the course of our production, events and business activities.
We are committed to protecting and respecting the personal data that we hold. This policy describes why and how we collect, store, transfer and use personal data, and sets out the rights available to individuals. It applies to personal data obtained by or provided to us, whether by individuals themselves, by others acting on their behalf, or from other sources.
Personal data is any information relating to an identified or identifiable living person. When collecting and using personal data, our policy is to be transparent about why and how we collect, process, store and transfer that data. We process personal data for a range of purposes; the means of collection, the lawful basis for processing, and the applicable retention periods are set out in the sections below.
The personal data obtained by or provided to us is either supplied directly by the individual concerned, by a third party acting on their behalf, or obtained from a publicly available source (for example press articles, social media profiles, or online searches). Where we receive personal data relating to an individual from a third party, we ask that third party to provide the individual with the necessary information about how their data will be used and, where appropriate, to refer them to this policy.
2. Security
We take the security of all the data we hold seriously. We have implemented appropriate technical and organisational measures to help ensure that personal information is kept safe and secure, including the following:
- relevant staff and contributors are made aware of their responsibilities in relation to data protection, confidentiality and security;
- we maintain policies and procedures, and review the appropriateness of the safeguards we have in place, on a regular basis; and
- information provided to us is stored in a secure manner, with access limited to those who need it.
The transmission of information over the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of data transmitted to us by that means, and any transmission is at your own risk. Once we have received your information, we will apply appropriate procedures and security measures to help prevent unauthorised access.
3. Data that we process and hold
The data we process depends on the nature of our interaction with you. Where we engage with individuals, we ask that only the personal data necessary for the purposes of that engagement is provided.
(a) Why do we process data?
We may process personal data for a range of purposes, including:
- responding to enquiries from members of the public, clients and partners;
- as part of, and in connection with, our production and creative activities — including developing, producing, exhibiting, distributing, publicising, advertising and promoting our film, video and branded content by any media, now known or later devised, throughout the world;
- planning, promoting, managing and delivering events, including managing registrations, guest lists, accreditation and attendee communications;
- sending you our newsletter and other marketing communications where you have asked to receive them;
- operating and managing our business effectively and lawfully; and
- making and receiving payments.
(b) What data is processed, and on what basis?
The data we process, and the lawful basis for processing it, depends on the purpose for which the data was gathered and the category of individual it relates to.
Members of the public, clients and partners (who contact us by phone, email, through our website contact form, or otherwise in writing):
- your name, email address, telephone number (where provided) and the contents of your message — to respond to your enquiry and for administrative purposes (such processing being necessary for the purposes of our legitimate interests in operating our business and responding to enquiries).
Newsletter and marketing subscribers (who sign up to receive updates from us):
- your name (where provided) and email address — to send you our newsletter and other marketing communications about our work, projects and events (such processing being carried out on the basis of your consent). You can withdraw your consent and unsubscribe at any time, either by using the unsubscribe link in any message we send or by contacting us using the details in section 9. Withdrawing your consent will not affect the lawfulness of any processing carried out before you withdrew it.
Event attendees, guests and registrants:
- your name, contact details, organisation and job role, dietary or accessibility requirements, and (where relevant) images and audio-visual recordings captured at events — to administer registration and attendance, to communicate with you before, during and after an event, and to record and promote the event (such processing being necessary for the purposes of our legitimate interests and, where required, undertaken with your consent).
Contributors, contractors, freelancers and prospective collaborators:
- your name, contact details and correspondence — to correspond with you and for administrative purposes (necessary for the performance of a contract with you, or steps taken prior to entering into one, and for the purposes of our legitimate interests);
- your image and other information contained in identity documents such as a passport or driving licence — to verify your identity and to ensure compliance with relevant laws (necessary for the performance of a contract with you and for the purposes of our legitimate interests);
- information about your work history, qualifications and experience — to assess your suitability to work with us or contribute to our projects, and to comply with our contractual and regulatory obligations (necessary for the purposes of our legitimate interests);
- information about you available on social media and the internet, including images and other information — to verify your identity and assess your suitability to work with us or contribute to our projects (necessary for the purposes of our legitimate interests);
- where relevant, information about your physical or mental health, or accessibility requirements — to assess your suitability to take part safely in our projects or events and to meet our health and safety and duty of care obligations (necessary to comply with our legal obligations and, in the case of special category data, undertaken with your consent); and
- your financial details, including your bank details — to make payments to you or reimburse pre-approved costs or expenses (necessary for the performance of a contract with you, or steps taken prior to entering into one).
Where we process special category personal data (for example information about health), or data relating to criminal convictions or offences, we do so only where a lawful basis and an appropriate condition for processing applies — which in most cases will be your explicit consent, our legal obligations, or reasons of substantial public interest.
(c) How long do we hold data for?
We retain personal data for as long as is considered necessary for the purpose(s) for which it was collected. For those involved in our productions, we are likely to retain personal data for as long as is necessary to develop, produce, exhibit, distribute, advertise, publicise and promote the relevant content, in line with our legitimate interests and legal obligations. Some data will need to be kept for longer, typically for legal, contractual, tax or accounting purposes. Personal data that is no longer required will be securely deleted or destroyed.
4. Sharing personal data
We will only share personal data with others where we are legally permitted to do so. When we share data, we put appropriate contractual arrangements and security measures in place to protect it and to maintain our data protection, confidentiality and security standards.
Your personal information is processed by our staff and, where appropriate, by third parties who support us in delivering our services, including:
- commissioning, financing and distribution partners involved in our creative and production activities, such as broadcasters, platforms, sales agents, distributors and financiers;
- production and creative partners, such as post-production facilities, technology and AI service providers, and co-producers;
- event partners and suppliers, such as venues, production crews, ticketing and registration providers, and hospitality suppliers; and
- professional and operational service providers, such as IT and cloud service providers, insurers, health and safety advisers, legal and accountancy advisers, and regulatory or government bodies where required.
We may occasionally share your data with other third parties on an ad-hoc basis; where we do, we will make this clear at the relevant time. We may also receive requests from third parties with the authority to obtain disclosure of personal data — for example to check our compliance with applicable law, to investigate an alleged offence, or to establish, exercise or defend legal rights, such as from the police, courts or regulatory bodies.
Where you contribute to a production or appear at an event, relevant personal data (and, where you provide it, special category data) may be shared with our production teams and the partners set out above, and — to the extent it forms part of the finished content or event — may be made available to the public when that content is published or the event takes place.
5. International transfers
Although we are based in the United Kingdom, our business is global. This means that the data we collect from you may be transferred to, and stored at, a destination outside the UK. Where that is the case, we will ensure that appropriate safeguards are in place — such as an adequacy decision or standard contractual clauses — so that your personal information remains protected and is processed in accordance with this policy.
6. Your rights
Individuals have certain rights over their personal data, including the following:
- to request access to the personal data we hold about them;
- to request that we rectify any inaccurate personal data we hold about them;
- to request that we erase their personal data;
- where we process personal data on the basis of consent, to withdraw that consent at any time;
- to restrict or object to our processing of their personal data, and the right to data portability; and
- to request information about any automated decision-making or processing we may undertake.
If you wish to exercise any of these rights, please email us at hello@jamesdrakemedia.com.
Please note that most of these rights are not absolute and apply only in certain defined circumstances. As a result, we may not always be able to comply with a request, but we will explain our reasons if that is the case.
7. Cookies and similar tracking technology
We, together with our service providers and certain third parties, use cookies and similar technologies (such as tracking pixels and web beacons) on our website in order to:
- perform functions necessary to provide our services, such as keeping our content and website secure;
- enhance your experience by remembering your preferences, such as your preferred language; and
- monitor, evaluate and improve the use and operation of our website, such as identifying bugs and errors.
Cookies, tracking pixels and similar technologies can generally be disabled or removed using the tools available in most web browsers, and in some cases blocked in future by adjusting your settings. Browsers offer different options, so you may need to set your preferences separately in each browser you use.
8. Complaints
We hope you will never need to, but if you wish to complain about our use of personal data, please email the details of your complaint to hello@jamesdrakemedia.com. We will review and respond to any complaint we receive.
You also have the right to lodge a complaint with the UK data protection regulator, the Information Commissioner’s Office (“ICO”). For further information on your rights and how to complain to the ICO, please visit https://ico.org.uk/concerns.
